      MEMBERSHIP TERMS AND CONDITIONS

       

      DEFINITIONS

      In these Terms and Conditions, unless the context otherwise requires, the following words and expressions shall have the following meanings:

      a) “Account” means Member’s account containing details including Membership Identification, Member’s Personal Information, record of accumulated Points and Points balance;

      b)  “Member” or “Members” means individual(s) who has/have personally signed up, applied for and has/have been accepted by T PRIVILEGE as participating member(s) of the Programme and granted T PRIVILEGE Card in accordance to the Terms and Conditions set forth herein;

      c) “Membership Identification” means identification of membership (including Password, Member’s ID and PIN) under the Programme in accordance with these Terms and Conditions;

      d)  “Merchant” or “Merchants” means the participating merchant(s) of the Programme;

      e)  “Mobile App” means the mobile application(s) owned and operated by T PRIVILEGE in relation to Programme;

      f)  “Point” or “Points” means the Points awarded to Members for redemption of purchases (such as products, services or properties) made at participating Merchants’ outlets under the Programme;

      g)  “Programme” means T PRIVILEGE Loyalty Programme operated by T PRIVILEGE;

      h)  “Rewards” means the products, services, rewards, gifts or other benefits made available by Merchants under the Programme which may be redeemed by Members by using his/her Points;

      i)  “T PRIVILEGE Card” or “the Card” means T PRIVILEGE Loyalty Programme membership card;

      j)  “Total Invoice Value” means the total amount charged by a Merchant for Member’s purchase of goods or services at a Merchant’s outlet after deduction of any applicable discounts and rebates while for a food and beverages outlet, the total amount charged by a Merchant will be inclusive of service charges and government service tax or any other taxes as imposed under the applicable law;

      k)  “Website” means the website owned and operated by  Tropicana Corporation Berhad and its’ subsidiaries, including T PRIVILEGE (“Tropicana group of companies”) in relation to the Programme and located at www.tropicanacorp.com.my or any other addresses which T PRIVILEGE deems fit from time to time.

      1. Membership

      1.1)    Membership is open to residents of Malaysia and expatriates residing in Malaysia only.

      1.2)    The following individuals are eligible to participate in this Programme (“Eligible Participants”):- 

      a)    Malaysians or expatriates residing in Malaysia, who are 18 years of age and above at the time of entry into the Programme;
      b)   a shopper at the Venue;
      c)    a purchaser who has purchased property from Tropicana group of companies during the Programme; or
      d)   an existing member of the Programme

      Only Eligible Participants who fulfil the conditions under this Clause 1.2 are eligible to participate in this Programme.

      1.3)   If the individuals are under 18 years of age, the parent, guardian or person with parental responsibility is deemed to consent to the processing of the child's personal data and accept and agree to be bound by these Terms and Conditions on behalf of the child and take responsibility for his or her actions. We will close any membership used exclusively by such children and will remove and/or delete any personal data we believe was submitted without any parental consent by any child under the age of 18.

      1.4)  An Eligible Participant may sign up and register for the Programme with T PRIVILEGE through the Mobile App or by any other methods that T PRIVILEGE may decide to implement and establish from time to time and may then earn Points on various purchases at participating Merchants’ outlets upon and subject to these Terms and Conditions;

      1.5)    By signing and submitting the application of membership, the applicants accept and agree to these Terms and Conditions.

      1.6)   Membership and Members’ entitlement to membership benefits and privileges of the Programme, including the redemption of Points and Rewards, shall be in accordance with these Terms and Conditions.

      1.7)    Approval and grant of membership shall be at the sole and absolute discretion of T PRIVILEGE. The T PRIVILEGE Card shall be issued to the Member from the date of T PRIVILEGE’s approval on his/her application.

      1.8)     Each Eligible Participant shall only apply for and hold one (1) valid Card only as a Member at any one time. Each member will be issued a form of Membership Identification which T PRIVILEGE deems fit.

      1.9)    T PRIVILEGE reserves the right to reject additional or multiple applications if T PRIVILEGE determines in its sole and absolute discretion that the applications are made by the same person.

      1.10)  The application of membership under the Programme is FREE from any charges. Notwithstanding this, T PRIVILEGE reserves the right to apply any charges and membership fees at any time as it deems fit.

       

      2. T PRIVILEGE Card

      2.1)    The use of T PRIVILEGE Card by Members shall be in accordance with these Terms and Conditions which may be amended by T PRIVILEGE from time to time.

      2.2)  T PRIVILEGE Card, the Points and all the benefits and privileges of membership are non-transferable and non-assignable to third parties and exclusively reserved for the Members.

      2.3)    T PRIVILEGE Card shall not be pledged by any Member as security for any purpose whatsoever.

      2.4)   T PRIVILEGE Card shall at all times remain the property of T PRIVILEGE and shall be returned to T PRIVILEGE immediately upon cancellation or termination of membership and may be repossessed by T PRIVILEGE at any time for any reason as T PRIVILEGE deems fit.

      2.5)    T PRIVILEGE Card shall be used by the Members in the Merchant’s outlets in the following venue:

       a)    Tropicana Golf & Country Club, bearing the postal address of Jalan Kelab Tropicana, 47410 Petaling Jaya, Selangor Darul Ehsan (“TGCR”); 
      b)   Tropicana Gardens Mall, bearing the postal address of No. 2A, Persiaran Surian, Tropicana Indah, 47810 Petaling Jaya, Selangor Darul Ehsan; and
      c)    Such other venues to be determined at the absolute discretion of T PRIVILEGE (collectively referred to as “Venues”) from time to time.


      3. Awarding and Redemption of Points and Rewards

      The awarding and redemption of Points will be awarded to the Members as per the following:-

      3.1)    Awarding of Points:
        Property Purchase                        - RM10 = 1 point
        Tropicana Golf & Club Resort     - RM10 = 1 point (Club Membership & Events)
                                                                 - RM  1 = 1 point (F&B, Golf & Sport)
        External Merchants/ Partners     - RM  1 = 1 point

        Tropicana Gardens Mall               - RM  1 = 1 point

      3.2)    Redemption of Points:
         100 points = RM1

      3.3)    An Account must be in good standing upon the time of awarding or redemption of Points as follows:-
              a)    the Account has sufficient Points for redemption;
              b)    the Account is not deactivated
              c)    the Account is not blacklisted; and
              d)    the Account is not under investigation for any fraudulent transactions.

      3.4)   A Member may utilise the Points earned at all Merchants’ outlets at the Venues or at any other places or method specified by T PRIVILEGE from time to time. Member may refer to the current list of Merchants which is available on the Website or Mobile App or any other sources as determined by T PRIVILEGE.

      3.5)    When a Member utilises his/her Points, the Points shall be utilised on first in first out basis.

      3.6)  A Member may utilise his/her Points in full or partially to settle the Total Invoice Value, subject to the compliance with the procedures for redemption in accordance with these Terms and Conditions.

      3.7)  For a partial redemption due to insufficient Points, the remaining unpaid Total Invoice Value is payable by the Member to the Merchant in the normal course of business (either by cash or credit card, as required by the Merchant) and the Member will earn Points on such part of the Total Invoice Value payable by cash or credit card.

      3.8)  T PRIVILEGE reserves the right to suspend a transaction and/or reallocate, recalculate, reverse or adjust the Points or take any necessary action, with or without any notice in the event that T PRIVILEGE has a reasonable ground to suspect that the Points were awarded, earned or redeemed fraudulently or in error.

      3.9)    Points are not exchangeable for cash and cannot be converted to cash.

      3.10) The Member will be entitled to all awarded Points subject to these Terms and Conditions and a Merchant may perform an offline Point awarding transaction in the event the Loyalty System is offline as verified and confirmed by T PRIVILEGE.

      3.11)   A Member may check the history and record of Points’ accumulation, to check and verify the correctness and accuracy of current Points balance, any other relevant information available under his/her Account at the Members’ own risk through Website, or any other methods as T PRIVILEGE may decide to establish from time to time.

      3.12) There shall be no awarding of retrospective Points for backdated receipts. Points are only awarded for receipts/purchases made on the day of purchase and stay afloat for seven (7) calendar days. 

      3.13) Points will be awarded or redeemed at the rate as agreed between T PRIVILEGE and the Merchant when a Member purchases goods or services at the Merchant’s outlets which may vary among the Merchants.

      3.14) The Points shall automatically expire and become invalid upon expiry of twenty four (24) months from the date of transaction (“Expiry Date”). Members are encouraged to redeem their accumulated Points before the Expiry Date.

      3.15) Any accepted redemption shall not be cancelled and the redeemed Rewards are not exchangeable for cash and non-returnable unless otherwise stated. Any dispute concerning goods and services received as Rewards shall be settled between the Member and the Merchant, service establishment and/or supplier, from which the goods or services were purchased. T PRIVILEGE will bear no responsibility for resolving such disputes, or for the dispute itself.

      3.16) The available Points after each redemption will be recalculated automatically by the Loyalty System for the Account but will thereafter be reflected in the Tropicana 360 mobile app.

      3.17) The Rewards are subject to availability and further subject to all applicable rules and these Terms and Conditions (including booking requirements, cancellation restrictions, return conditions, warranties and limitations of liability) imposed by the respective Merchant and T PRIVILEGE.

      3.18) T PRIVILEGE shall neither be liable nor held to be liable for any claims, loss, costs, expenses or damages of whatever nature resulting from the redemption of any of the Points or Rewards by the Members.

      3.19) T PRIVILEGE shall make no representation or warranty (either express or implied) of any kind with regards to the condition, fitness for purposes, merchantable quality or otherwise of any goods or services or any Rewards supplied by Merchants or third party.

      3.20) T PRIVILEGE shall not be responsible for any failure or delay by a Merchant or third party to supply such Rewards.

      3.21)  T PRIVILEGE shall not be responsible to the Members in the event the Merchant is not able to proceed with the process of awarding or redemption of Points on the date of Members’ purchase of goods or services due to malfunction of the Electronic Equipment or inability of the Merchant’s employees, agent and/or servants to proceed with such process.

      3.22)  Points can be redeemed once they are credited into the Account.

      3.23)  T PRIVILEGE shall be disclaimed for any delay in the posting of the transactions, the accrual and/or accumulation of the Points.

      3.24)  All awarding or redemptions of Points are subject to Merchant’s final acceptance.

      3.25) In the event of any refund or purchase/order cancellation in relation to any purchase of goods or services, the Merchant may deduct the whole or part of the Points in the Account in accordance with the amount of such refund or cancellation at its deems fit subject to the Merchant’s policy.

       

      4. Loss, Stolen, or Damage of Card

      4.1)   In the event that the Card is lost, stolen or damaged, Member must promptly report to T PRIVILEGE Membership Counter, as stated below (“T PRIVILEGE Membership Counter”) in person or by email followed by written notification with supporting documents addressed to T PRIVILEGE at the address and details described below to safeguard the Account and Members’ privileges. T PRIVILEGE shall not be responsible for any losses suffered by the Members as a result of his/her delay in reporting such loss, stolen or damage card to T PRIVILEGE.

      4.2)  T PRIVILEGE will take safety measures by deactivating the lost, stolen or damaged Card or any information stored under the Account within reasonable time upon Member’s notification. T PRIVILEGE disclaim its liabilities on any losses or damages (either directly or indirectly) that may be suffered by the Member arising from the safety measures taken by T PRIVILEGE or any delay in invalidating the Card.

      4.3)   T PRIVILEGE will assist in reactivating the Account and replace the lost, stolen or damaged Card. Upon the reactivation, T PRIVILEGE may at its absolute and sole discretion to transfer the Points balance, or any information stored under the Account to the replacement Card.

      4.4)    Members are advised to lodge a police report as soon as possible to substantiate the claim pertaining to the lost or stolen Card.

       
      5. Dispute

      5.1)    If there is any dispute on a Points transaction, a Member shall complete the particular form as required by T PRIVILEGE and submit such form with supporting documents to T PRIVILEGE Membership Counter within seven (7) days from the date of transaction or dispute whichever is earlier. Any submission after the seven (7) days will not be accepted.

      5.2)    T PRIVILEGE may at its sole and absolute discretion to settle the disputes as it deems fit. The decision by T PRIVILEGE shall be final and conclusive. T PRIVILEGE shall not be liable or responsible for any breach of any duty of care owed to such Member by any of T PRIVILEGE’s employees, staff or authorised personnel or any indirect, consequential or economic losses, loss of profits, loss of opportunity or punitive damages of any kind.

       

      6. General

      6.1)  These Terms and Conditions govern the membership (including awards, redemption and use of Points and Rewards by Member) and set out the agreement between T PRIVILEGE and each Member with regards to the Programme.

      6.2)   All Members agree that the Privacy Notice as stated on the Website shall form part of these Terms and Conditions. Acceptance of these Terms and Conditions by Members shall constitute the acceptance of the Privacy Notice. T PRIVILEGE reserves the right to amend or supplement the Privacy Notice from time to time. Any amendments to the Privacy Notice will be posted on the Website.

      6.3)   All Members and applicants are advised to read the Privacy Notice before accepting these Terms and Conditions.

      6.4)   The accuracy of personal information shall be verified by Members and Members shall notify T PRIVILEGE upon any changes on their personal information.

      6.5)   Member information such as name, identification number/passport number and email must be updated in the Account to be eligible to participate in the Programme and for verification in cases of any dispute.

      6.6)    T PRIVILEGE and the Merchants reserve the right to request the Member to produce his/her Card, Member’s identification and personal identification (including MyKad or Passport) to facilitate the Points transaction and for verification purposes in accordance to the Privacy Notice.

      6.7)     T PRIVILEGE reserves the rights at its sole and absolute discretion to amend or delete any of these Terms and Conditions at any time as it deems fits without prior notification to Members. Any variations, addition or amendment to these Terms and Conditions will be posted via the Website no later than seven (7) days prior to the effective date of such amendments. The continuing use of T PRIVILEGE Card and engagement with the membership by Members shall constitute acceptance of any variation, addition, or amendments to these Terms and Conditions and Member shall be bound by the same.

      6.8)       Members have the obligation to check the Website for updates on these Terms and Conditions from time to time.

      6.9)    T PRIVILEGE reserves the right, at any time to vary, modify, replace, substitute or terminate the Programme or the Rewards, benefits, features or privileges under the Programme or withdraw Points from use without prior notification to Members and without being liable in any way to the Members.

      6.10)    T PRIVILEGE may at its sole and absolute discretion terminate the memberships without prior notification and forfeit all the Points balance recorded in the Account and redeemable Rewards and reject any refund in the events of including but not limited to:-
          i.   A member accrues, redeems, or uses T PRIVILEGE Card, membership (including any benefits and privileges) or the Points for any       unlawful or fraudulent activity or in other manners which T PRIVILEGE determines to be improper;        
         ii.    A member breaches any of these Terms and Conditions;
         iii.   A member is deceased or is declared a bankrupt; or

      6.11)    T PRIVILEGE, its subsidiaries, related companies, Merchant and its service providers, or agents shall not be liable for any cost, expense, loss or damages, whether direct or indirect, special or consequential or loss of business, revenue or profits, injury or damage to property or any nature suffered by Members or any authorised person by Members arising from:-
            i.       any omission, error or inaccuracy of record, awarding or redemption of Points or Points balance including as a result of        failure or breakdown of any Electronic Equipment used in connection with the Programme;
            ii.      any technical malfunction, operator fault, error, deficiency, defects of the T PRIVILEGE Card or any part thereof;
            iii.     any act, error, delay or default in carrying out the Programme;
            iv.     withdrawal of any benefits or privileges conferred on Members under the Programme;
            v.      any act, omission, error of its service provider, agents, employees, sub-contractor or business partners;
         vi.   any claim for libel, slander, infringement of any intellectual property rights arising from the transmission and receipt of       material in connection with the Programme and any claims arising out of any act or omission of Members;
            vii.   any suspension, deactivation, termination or cancellation of account or membership; and
           viii.  any circumstances beyond the reasonable control of T PRIVILEGE.

      T PRIVILEGE or Merchant may refuse a request for awarding or redemption of Points on the occurrence of any transaction as set out in 7.11(i), (ii) or (vii) above.

      6.12)    Members are responsible for the security of their Membership Identification. T PRIVILEGE accepts no liability for the disclosure of the Membership Identification by the Member to a third party, whether intentionally or otherwise. T PRIVILEGE reserves the right to protect an Account from being accessed if T PRIVILEGE has reasonable grounds to believe that the security of the particular Account has been breached or at the risk of exposure.

      6.13)    While T PRIVILEGE uses reasonable efforts to include up-to-date information on the Website and in all its publications, T PRIVILEGE makes no warranties or representations as to their accuracy, reliability, completeness or otherwise. The contents, materials, products or other services available in T PRIVILEGE publications or accessible through the Website are on “as is” and “as available” basis. T PRIVILEGE disclaims all warranties (express or implied) including but not limited to, merchantability, fitness for purpose and non-infringement, in relation to the contents, materials, products or other services published in any of its publications or available on the Website.

      6.14)    T PRIVILEGE does not warrant that the Website will be error-free, free of viruses, bugs, online interruption or other harmful threats. Members are responsible to implement security measures in their computers or mobile devices before accessing the Website. T PRIVILEGE shall not be liable in any way for any direct, indirect, punitive, incidental, consequential or other damage howsoever arising out of any of the following;        
         a)  the use of, or access to, the Website;
         b) delay or inability to use or access the Website; and/or
       c)  any content, information, material, products or services published in, posted on, advertised in or obtained through T PRIVILEGE publications or the Website or otherwise.

      6.15)    Notice of any matter in relation to the Programme shall be deemed informed/delivered to Members via any one of the methods as follows: 
        a)  by posting on the Website;
        b)  by sending an email to Members who have provided email address to T PRIVILEGE, the Merchants and/or Tropicana’s group of companies; 
        c)  by publication in a newspaper; 
        d)  by short messaging services (SMS); or 
        e)  by Mobile App.

      6.16)   All notices, requests and/or other communications to be given by Members to T PRIVILEGE under these Terms and Conditions must be communicated in writing and sent by hand or registered post to the following address:

      Notices sent by way of registered post shall be deemed delivered on the fourth (4th) day of posting and where notices are delivered personally by the sender, it shall be deemed to be served when delivered.

      6.17)    T PRIVILEGE may further establish rules, procedures and policies in relation to any matter regarding the Programme from time to time, all of which shall form part of these Terms and Conditions. These Terms and Conditions as set out herein shall prevail in the event of any conflict or inconsistency with any other documents, statements, rules, procedures, policies or communications issued by T PRIVILEGE, including Frequently Asked Questions (FAQs) and advertising or promotional materials. These Terms and Conditions together with the aforesaid further rules, procedures and policies shall constitute the entire agreement and understanding between T PRIVILEGE and the Members with respect to the Programme and shall not be subject to any other agreement, understanding, warranty or representation not expressly contained or referred to in these Terms and Conditions and the aforesaid further rules, procedures and policies.

      6.18)    If any of the provisions herein contained should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

      6.19)    No delay or indulgence by T PRIVILEGE in enforcing any of these Terms and Conditions nor the granting of time by T PRIVILEGE to Members shall prejudice the rights or powers of T PRIVILEGE nor shall any waiver by T PRIVILEGE of any breach constitute a continuing waiver in respect of any subsequent or continuing breach.

      6.20)    These Terms and Conditions are governed by the laws of Malaysia and Members shall submit to the exclusive jurisdiction of the courts of Malaysia.

      1. Who is eligible to register for a T PRIVILEGE membership?
        All residents of Malaysia and expatriates, aged 18 years old and above are eligible to register for a T PRIVILEGE membership.

      1. How do I apply for a T PRIVILEGE membership?
        You can apply for membership by downloading Tropicana 360 mobile app on the Apple App Store, Google Play or Huawei App Gallery.

      1. How many T PRIVILEGE accounts can I have?
        You can only have ONE T PRIVILEGE account.

      1. How many T PRIVILEGE cards can I hold or add to my T PRIVILEGE account?
        You can only hold one (1) valid T PRIVILEGE card at any one time.

      1. How do I know if I’m an existing T PRIVILEGE member?
        Our Tropicana 360 mobile app will prompt you if you have registered with us before. You just need to login into your account using the email you registered with us.

      1. How do I renew my membership?
        You do not need to renew your membership as the membership does not expire.

      1. How do I know whether my membership is still valid?
        There is no expiry to the membership.
        Subject to change according to Terms and Conditions.

      1. How much do I need to pay for the membership fee?
        You do not need to pay for T PRIVILEGE membership, it is FREE FOR LIFE.  

      1. Where can I use my membership?
        You can use T PRIVILEGE at participating retailers and other Tropicana Business Units. You can check out the list of participating merchants' outlets and Tropicana Business Units in Tropicana 360 mobile app.

      1. Can I register at a participating merchants' outlet?
        No, you are unable to register at a participating merchants' outlet. Please refer to Q4 on how you can register.

    • TERMS AND CONDITIONS GOVERNING THE USE OF
      T PRIVILEGE CARD/E-CARD

       

      The issuance and the use of the T Privilege Card/e-Card shall at all times be subject to the following terms and conditions:

      1. Definitions

      1.1. In this Agreement:-
      • Tropicana means Tropicana Corporation Berhad (Company No. 47908-K), a company incorporated in Malaysia and having its office at Unit 1301, Level 13, Tropicana Gardens Office Tower, No. 2A, Persiaran Surian, Tropicana Indah, 47810 Petaling Jaya, Selangor Darul Ehsan and shall include its subsidiaries.

      • Tropicana Property means a purchase of any number of unit(s) of property within the property development undertaken by Tropicana and/or its subsidiaries by the Member or non-Member buyer directly from Tropicana and/or its subsidiaries and does not apply to such properties in a sub-sale or secondary transaction.

      • T Privilege Physical Card is issued to Gold, Platinum, and Diamond members.

      • T Privilege e-Card is issued to Priority members. The member is required to download the Tropicana 360 App to activate the e-Card.

      • T Privilege Card/e-Card means the T Privilege Card/e-Card issued by Tropicana under the T Privilege Loyalty Programme.

      • T Privilege Membership Programme means the T Privilege Loyalty Programme drawn up with benefits and privileges promoted by Tropicana and at participating outlets for members’ enjoyment.

      • Member means T Privilege Card/e-Card Member holding a valid T Privilege Card/e-Card.

      • Buyer Rebate means the discount given to the Member on Tropicana Property purchased from Tropicana directly.

      • Introducer’s Cash Reward means the commission given to the Member who had introduced a non-Member buyer who had successfully purchased a property from Tropicana by executing the SPA and having paid a sum not less than Thirty-five (35%) percent of the total purchase price of the Tropicana Property.

      • Participating Outlets means the merchants, suppliers, or establishments participating in the T Privilege Loyalty Programme from time to time.

      • SPA means the duly stamped Sale & Purchase Agreement executed between Tropicana and the Member or the non-Member buyer, as the case may be, in respect of the Member’s or non-Member’s purchase of the Tropicana Property from the project(s) undertaken by Tropicana.

      2. T Privilege Membership (For Tropicana property only)

      2.1.

      The T Privilege Membership is given free of any charges to every person or company who has purchased Tropicana Property directly from Tropicana. The Member will be issued a T Privilege Card/e-Card to be used in connection with the benefits and privileges under the T Privilege Loyalty Programme after the purchaser has executed the SPA and has paid no less than Thirty-five percent (35%) of the purchase price of the Tropicana Property.

      2.2.

      For new T Privilege Membership, in the event of termination of purchase for any reason whatsoever, the T Privilege Card/e-Card shall be terminated forthwith and the Member shall return the membership card (Gold, Platinum, and Diamond members only) to Tropicana for cancellation.

      2.3.

      The T Privilege Membership shall remain with the first owner of the Tropicana Property even after the said Tropicana Property has been sold, assigned, transferred, or disposed of. The sub-sale purchaser of the Tropicana Property is not entitled to the T Privilege Card/e-Card membership.

      2.4.

      The T Privilege Card/e-Card is a privilege card that entitles the Member to enjoy Buyer Rebate, Introducer’s Cash Reward, and privileges at the Participating Outlets as provided herein.

      2.5.

      The T Privilege Membership is non-transferable and non-assignable and is for the exclusive use of the Member only.

      2.6.

      The T Privilege Card/e-Card is NOT a credit card or debit card or charge card or others similar to these. It cannot be used to obtain cash, cash vouchers, or exchange for cash or other products or services other than the Introducer’s Cash Reward.

      2.7.

      There are four (4) categories of T Privilege Membership, namely, Priority T Privilege, Gold T Privilege, Platinum T Privilege, and Diamond T Privilege. The type of T Privilege Membership tier is determined by the aggregate value of the property(ies) purchased by the Member as follows: -

      1. Priority T Privilege – total purchase value of RM190,000 to RM999,999;
      2. Gold T Privilege – total purchase value of RM1,000,000 to RM1,999,999;
      3. Platinum T Privilege – total purchase value of RM2,000,000 to RM2,999,999; and
      4. Diamond T Privilege – total purchase value of RM3,000,000 and above
       2.8.

      The Privileges of Priority T Privilege, Gold T Privilege, and Platinum T Privilege, and Diamond T Privilege are as follows: -

      • Priority invitation to Tropicana’s property launches, events, other attractive promotions, etc.;
      • Special deals on dining, shopping, and services at Participating Outlets;
      • Receive the latest e-Updates of the exclusive bi-Monthly Tropicana Magazine in your inbox via weblink;
      • You may also collect the hard copy from any of our property galleries.

      (i)     Priority T Privilege Members 

      1. Buyer Rebate - 1.5% discount on Member’s next and every subsequent Tropicana Property purchase from Tropicana (subject to change without prior notice);
      2. Introducer’s Cash Reward - Enjoy up to 1% commission (based on purchase price) when Member introduces a non-Member buyer to purchase a Tropicana Property from Tropicana (subject to change without prior notice);

      (ii)   Gold T Privilege Members

      1. Buyer Rebate - 2.0% discount on Member’s next and every subsequent Tropicana Property purchase from Tropicana (subject to change without prior  notice)
      2. Introducer’s Cash Reward - Enjoy up to 1% commission (based on purchase price) when Member introduces a non-Member buyer to purchase a Tropicana Property from Tropicana (subject to change without prior notice);

      (iii)   Platinum T Privilege Members

      1. Buyer Rebate - 2.5% discount on Member’s next and every subsequent Tropicana Property purchase from Tropicana (subject to change without prior notice);
      2. Introducer’s Cash Reward - Enjoy up to 1% commission (based on purchase price) when Member introduces a non-Member buyer to purchase a Tropicana Property from Tropicana (subject to change without prior notice);

      (iv)   Diamond T Privilege Members

      1. Buyer Rebate - 3.0% discount on Member’s next and every subsequent Tropicana Property purchase from Tropicana (subject to change without prior  notice);
      2. Introducer’s Cash Reward - Enjoy up to 1% commission (based on purchase price) when Member introduces a non-Member buyer to purchase a Tropicana Property from Tropicana (subject to change without prior notice);
      2.9.

      Tropicana shall from time to time upgrade a Member’s T Privilege Membership based on the latest aggregate value of the properties purchased by the Member.

      2.10.

      In the case of joint purchasers, each of the joint purchasers is entitled to the T Privilege Membership.

      2.11.

      For corporate purchasers, nomination for Privilege Membership is limited to Directors only. The Director(s) who is the signatory(ies) in the SPA is entitled to be the nominee(s) to the corporate membership. However, the said company may request to change the nominee(s) or to have additional nominee(s) with valid reasons by providing the latest Form 24, Form 49, and any other supporting documents to Tropicana for verification purposes.

      2.12.

      For the purpose of determining the type of Privilege Membership in the case of joint purchasers and/or corporate purchasers, each of the purchasers and/or nominees shall be entitled to the full value of the purchase price in calculating the aggregate value of the Tropicana Property purchased.

      2.13.

      Points will be awarded to property purchases made from 1 January 2022 onwards. The points will be reflected in the Tropicana 360 App to Members who had successfully purchased a property from Tropicana by executing the SPA and having paid a sum not less than Thirty-five (35%) percent of the total purchase price of the Tropicana Property.

       

      3. Tropicana Property Related Privileges

      3.1.

      The Buyer Rebate on Tropicana Property is only applicable to the next and every subsequent Tropicana Property purchased by the Member, provided always that the Member is named as the purchaser in the SPA. Depending on the type and value of the Tropicana Property purchased, Tropicana may from time to time review or vary the Buyer Rebate without prior notice. Tropicana may at its absolute discretion withdraw the Buyer Rebate from a Member of the Member elects to remove his/her name from the SPA or nominate a third party in his/her place prior to full settlement of the purchase price.

      3.2.

      The Introducer's Cash Reward is only given to Member during the promotional period(s), such promotional period(s) is to be solely determined by Tropicana at its discretion and subject to such terms and conditions as may be prescribed by Tropicana during such promotional period(s). In order to enjoy the Introducer’s Cash Reward, the Member introducing the non-Member buyer must and shall at the point when the Member introduces the non-Member buyer to Tropicana specifically inform Tropicana of such introduction and identify the non-Member buyer to Tropicana or its officer and such introduction shall be made before the non-Member buyer had signed the booking form and paid the booking fee (if any) for the purchase of the Tropicana Property. Tropicana shall not be liable to pay the Introducer’s Cash Reward to any Member who had failed to comply with this requirement and procedure.

      3.3.

      The Introducer’s Cash Reward will be paid out to the Member by way of the cheque after the introduced non-Member buyer has both executed the SPA and paid a sum not less than Thirty-five percent (35%) of the purchase price. Depending on the type and value of the Tropicana Property purchased, Tropicana may from time to time review, vary, and/or withdraw the Introducer’s Cash Reward without prior notice.

      3.4. 

      The Introducer’s Cash Reward is only applicable for the introduction of a buyer who is not a T Privilege member at the point of introduction. In the case where an existing Member purchasing a Tropicana Property directly from Tropicana in joint names with a non-Member buyer, the Member is only entitled to the Buyer Rebate. The said Member is not entitled to both the Buyer Rebate and the Introducer’s Cash Reward at any one of such said transactions.

      3.5.

      Tropicana reserves the right to cancel, suspend, terminate or otherwise change the Buyer Rebate and/or the Introducer’s Cash Reward without assigning any reasons thereto and without any prior notification. Upon such cancellation, suspension, termination, or changes, Tropicana shall not be under any obligation to extend the same benefits to the Members.

       

      4. Discount Benefits – by Participating Outlets

      4.1.

      In order to enjoy the discount benefits at the Participating Outlets, the Member MUST present a valid T Privilege e-Card to the Participating Outlets before every transaction is entered into. The discount benefits are only applicable to current transactions and not previous or back-dated transactions.

      4.2.

      Special discounts are given by the Participating Outlets subject to such restrictions, exclusions, terms, and conditions as may be prescribed by the Participating Outlets and/or Tropicana from time to time at their absolute discretion.

      4.3.

      The Participating Outlets may at their absolute discretion cancel, suspend, terminate, reduce or otherwise change the discount benefits and may at their absolute discretion do not allow the use of the T Privilege Card by the Member during sales or promotional periods and/or for discounted items and/or when the T Privilege e-Card is presented together with any other privileges or discount related vouchers and/or cards.

      4.4.

      Tropicana shall not be liable to the Member in any manner whatsoever and howsoever for any goods and/or services purchased by the Member from any of the Participating Outlets and does not warrant the giving of such benefits and/or discounts by the Participating Outlets albeit the Member produces a valid T Privilege e-Card to such Participating Outlet.

      4.5.

      The T Privilege Loyalty Programme signage displayed at the Participating Outlets shall not be taken as a warranty by Tropicana that all goods and services available at the Participating Outlets shall be subject to discount.

      4.6.

      Unless otherwise specified, discounts are generally not applicable to tax, service charges, and other miscellaneous charges that are not included in the price of the goods or services purchased.

      4.7.

      Tropicana gives no representation or warranty with respect to any goods and/or services provided by the Participating Outlets under the T Privilege Loyalty Programme. In particular, Tropicana gives no warranty in respect of the quality of goods and/or services purchased from or rendered by the Participating Outlets or their suitability for any purpose. Any dispute concerning goods and/or services purchased from and/or rendered by the Participating Outlets shall be settled between the Member and the Participating Outlets involved. Tropicana will bear no responsibility for resolving such disputes or for the dispute itself.

       

      5. General

      5.1.

      Member must present a valid T Privilege e-Card prior to the transaction being entered into in order to enjoy the benefits and privileges under the T Privilege Loyalty Programme.

      5.2.

      Unless otherwise specified, benefits and privileges under the T Privilege Loyalty Programme are not valid for use with other ongoing promotions and discounts of Tropicana and the respective Participating Outlets.

      5.3.

      Tropicana gives no representation or warranties or endorsements for the goods or services shown in the Tropicana’s newsletters, magazines or Tropicana’s website pertaining to the Participating Outlets with respect to the pricing, the discounts, the promotion, and the availability of such goods and services advertised therein as such pricing, discounts, promotion, and availability may be changed, varied, suspended, terminated or withdrawn without prior notice by the Participating Outlets.

      5.4.

      Tropicana reserves the right to withdraw, suspend, terminate, substitute, or vary any of the benefits under the T Privilege Loyalty Programme from time to time without prior notice. Any substitution or variation by Tropicana of any benefits contained herein shall not entitle the Member to any claims or compensation from Tropicana for any and all losses or damages suffered or incurred by the Member, whether directly or indirectly caused.

      5.5.

      In case of any dispute relating to the Tropicana Property-related privileges under the T Privilege Loyalty Programme, the decision of Tropicana shall be final and conclusive.

      5.6.

      Tropicana is not liable for any loss or damage suffered by the Member due to any of the following reasons: -

      • any unauthorised use of the T Privilege Card/e-Card;
      • any failure of a Member to notify the Participating Outlets that a transaction is a T Privilege Loyalty Programme transaction;
      • any benefits not being available for any reason;
      • any failure to notify members of any changes in these Terms and Conditions, the T Privilege Loyalty Programme, the Participating Outlets, and T Privilege Card Handbook; and
      • The suspension and/or termination of the T Privilege Loyalty Programme.
      5.7.

      Tropicana reserves the absolute right to add, delete or amend these Terms and Conditions at any time without prior notice.

      5.8.

      Tropicana reserves the right to withdraw, suspend or terminate the T Privilege Loyalty Programme at any time it deems necessary without assigning any reasons thereto. In such a case, Tropicana shall give advance notice to the Member in the manner which Tropicana deems appropriate. Upon notification of such suspension or termination, the Member’s card shall be nullified and invalidated and Tropicana shall have no obligation to extend any benefits to the Members.

      5.9.

      Tropicana reserves the right to decline the issuance of or withdraw the T Privilege Card/e-Card at any time or terminate membership as and when necessary without prior notice.

      5.10.

      Tropicana reserves the right to use and utilize all information gathered from or under the T Privilege Loyalty Programme for marketing purposes and the Member and or the non-Member Buyer introduced by the Member shall be deemed to have consented to Tropicana using the same.

      5.11.

      The Member is responsible to notify Tropicana of any updates on their profile, change of address, or any other contact information to enable Tropicana to send appropriate updates on the T Privilege Loyalty Programme to the said Member. Such notification shall be in writing.

      5.12.

      Any request for a replacement card for any reasons whatsoever, not limited to loss or damaged cards, shall be subjected to a fee of RM20.00. The replacement card request is only applicable to Gold, Platinum, and Diamond members only.

      5.13.

      The use of the T Privilege Card/e-Card by the Member automatically infers acceptance of the prevailing terms and conditions of the T Privilege Membership Programme.

    • 1.   What is T PRIVILEGE Loyalty Programme?

            T PRIVILEGE Loyalty Programme is introduced to reward customers of Tropicana in recognition of their support and loyalty through the years.

       

      2.   Who is eligible to be a Member of the T PRIVILEGE Loyalty Programme?

      ·    Every individual and company who has purchased property(ies) directly from Tropicana of an aggregate value of RM190,000 and above is entitled to become a Member of this Loyalty Programme. Membership is absolutely free;

      ·    For joint-name purchasers – each of the joint purchasers is entitled to membership;

      ·    For corporate purchasers – nomination for membership is limited to Directors only. The Director(s) who is a signatory(ies) in the Sale & Purchase Agreement (SPA) is entitled to be the nominee(s) to the corporate membership. However, if there is a request by the same company to change the nominee(s) or to have additional nominee(s), Tropicana reserves the absolute right to request the latest Form 24, Form 49, and any other supporting documents for verification purposes.

       

      3.   What about an owner who bought Tropicana Property through a sub-sale transaction?

              Sub-sale Tropicana Property purchaser is not eligible to be a Member of the T PRIVILEGE Loyalty Programme.

       

      4.   How do I apply to become a Member?

      ·    No application is necessary. Tropicana will issue to each and every qualified purchaser a personalised T PRIVILEGE Physical Card to Gold, Platinum, and Diamond members for use;

      ·    T Privilege e-Card is issued to Priority members. The member is required to download the Tropicana 360 App to activate the e-Card before usage.

      ·    There are 4 types of T PRIVILEGE MEMBERSHIP, namely Priority T Privilege, Gold T Privilege, Platinum T Privilege, and Diamond T Privilege.

       

      5.   How does Tropicana categorise the 4 types of T PRIVILEGE MEMBERSHIP to the qualified Members?

              The type of T Privilege Membership issued to qualified Members is determined by the aggregate value of the property(ies) purchased as follows:

      ·    Priority T Privilege - total property value of RM190,000 to RM999,999;

      ·    Gold T Privilege - total property value of RM1,000,000 to RM1,999,999;

      ·    Platinum T Privilege - total property value of RM2,000,000 to RM2,999,999; and

      ·    Diamond T Privilege - total property value of RM3,000,000 and above;

       

      6.   I have bought properties from Tropicana under my own name and also under the name of my company. How do you determine the value of my purchases to justify the type of T Privilege Membership entitlement for me?

      ·    For property purchased under your company’s name;

      ·    You MUST be the signatory in the SPA in order for us to combine the value of all your purchases to categorise your T Privilege Membership type;

      ·    If you are not the signatory in the SPA or even if the signatory is a member of your family, we do not recognise it as the same purchaser;

      ·    After combining the purchase value of all the properties, ONLY one individual membership card will be issued under your name;

      ·    No corporate membership(s) will be given to your company(ies).

       

      7.   We are husband and wife who have individually bought properties from Tropicana. Can we combine the value of our properties purchased and both be entitled to upgraded memberships?

      ·    Yes, we can allow only husband and wife to combine their individual purchases by producing a copy of their marriage certificate as the supporting document for our file record;

      ·    However, we cannot combine the value of properties purchased by other members of the family (ie., children and parents, etc.);

      ·    This is not applicable to property(ies) purchased joint names with another party(ies).

       

      8.   Can my immediate families enjoy my T Privilege Membership Buyer Rebate?

      ·   Yes, we can allow immediate families within the same bloodline (parents, children, siblings) by producing the birth certificates as the supporting document for our file record;

      ·    However, we cannot combine the value of properties purchased by other members of the family (ie., children and parents, etc.);

      ·    This is not applicable to property(ies) purchased joint names with another party(ies).

       

      9.   Is my membership upgradeable?

              Yes, Tropicana shall from time to time upgrade a Member’s T Privilege Membership based on the latest aggregate value of properties purchased from Tropicana.

       

      10.   Is membership transferable? Is my membership transferable to my immediate family members?

      ·    Membership is non-transferable and privileges are only accorded to T Privilege Loyalty Programme;

      ·    Your membership is not transferable to any member of your immediate family.

       

      11.   What are the privileges of being a Diamond T Privilege Member?

      ·    Buyer Rebate - 3.0% discount on your next property and every subsequent property purchase from Tropicana (subject to change);

      15.   How is the Buyer Rebate given on my next property purchase from Tropicana?

      ·    You must be named as the purchaser in the SPA;

      ·    Rebate will be given in the form of a Credit Note to offset against the down payment of the purchase price;

      ·    Rebate is calculated based on the Nett discounted price after ALL the discounts;

      ·    Rebate given is not transferable to cash.

       

      16.   I am an existing cardmember and would like to purchase another 2 or more properties from Tropicana at the same time. In what way can I get the best Buyer Rebate for these properties?

      ·     Based on your existing card membership, you will get your entitled Buyer Rebate applicable for one property first;

      ·    You can then opt to pay upfront 35% on the one unit purchased to upgrade your membership immediately so that you are eligible for the upgraded Buyer Rebate for the second unit and so forth.

       

      17.   I am a corporate nominee cardmember and I intend to purchase property from Tropicana under my own name. Will I be entitled to a Buyer Rebate 

              No. For corporate membership, the Buyer Rebate is only applicable to the company’s next purchase of property from Tropicana.

      18.   I am an existing cardmember and I intend to purchase a property from Tropicana under my company’s name. How do I get the Buyer Rebate for my corporate purchase using my individual membership?

      ·    First, if you would like to enjoy the Buyer Rebate on your corporate purchase using your individual membership, you must be a shareholder of the company;

      ·  Tropicana reserves the absolute right to request the latest Form 24, Form 49, and any other supporting documents for verification purposes;

      ·    You must be one of the signatories in the SPA;

      ·    Your company needs to give us an official letter to request to transfer and combine the corporate purchase to your individual membership;

      ·    No corporate membership will be given to your company;

      ·    Your individual membership will be upgraded if necessary after combining the total purchase value.

      Special Note: This rule is also applicable to 2 individual card members who are joint name purchasers buying another property under their company where they are the same joint partners/shareholders.

      19.   We are an existing corporate purchaser. One of our directors is buying a property from Tropicana. Can our director be entitled to Buyer Rebate from our corporate membership?

      ·    First, if your director would like to enjoy the Buyer Rebate on his individual purchase using the privilege from the corporate membership, he must be a shareholder of the company;

      ·    Tropicana reserves the absolute right to request the latest Form 24, Form 49, and any other supporting documents for verification purposes;

      ·    He must also be one of the signatories in the earlier SPA;

      ·    Your company needs to give us an official letter to request to transfer all the privileges from the corporate membership to his individual membership;

      ·    The existing corporate membership will be terminated automatically and any corporate nominee membership card will also be void;

      ·    ONLY one individual membership card will be issued to the director to replace the corporate membership. The individual membership type will be based on the total purchase value after combining with the corporate purchase.

      20.   I have introduced a friend(s) to purchase property from Tropicana. When can I claim the Introducer’s Cash Rewards?
      The first 35% of the Purchase Price as per Stage 1, Stage 2(a), and Stage 2(b) of the Payment Schedule annexed as Third Schedule in the SPA has been duly settled by BOTH the Introducer and non-Member buyer to Tropicana Corporation Berhad or its subsidiaries; and any other terms and conditions that may be determined/stipulated from time to time by Tropicana Corporation Berhad and its subsidiaries; Tropicana will pay the Introducer’s Cash Reward by way of cheque to you.

      21.   I have introduced a friend to purchasing more than one unit of property from Tropicana. How do the Introducer’s Cash Rewards work?
      An introducer is entitled to a referral fee of up to 1% of the Nett purchase price for all units sold to the SAME PROSPECT on the SAME DATE. Subsequent unit purchased by the Prospect on a different date is not entitled to Introducer’s Cash Rewards.

      22.   I am a corporate nominee cardmember and I have introduced a friend(s) to purchase property from Tropicana. To whom will Tropicana pay the Introducer’s Cash Rewards, the company, or the nominee?
      Tropicana will pay the Introducer’s Cash Reward by way of a cheque to the nominee’s personal name.

      23.   Can the Introduced Buyer be eligible for T Privilege Membership?

                  ·   Yes, the introduced non-Member buyer will be eligible for T Privilege Membership on the condition that the value of the property purchased is RM190,000.00 and above. A T Privilege Membership card/e-Card will be issued after the introduced non-Member buyer has executed the SPA and has paid up at least 35% of the purchase price; 

                  ·   T Privilege Physical Card is issued to Gold, Platinum, and Diamond members; 

                  ·    Privilege e-Card is issued to Priority members. The member is required to download the Tropicana 360 App to activate the e-Card.


      24.   In the event of a lost, stolen, or damaged card, can I request a replacement card?

      ·    Yes, you can report it to Customer Careline at +603 7663 6888 or email [email protected] and request a replacement card at no additional cost. Our operating hours are 9 am to 6 pm, Monday to Friday.

      ·    The replacement card request is only applicable to Gold, Platinum, and Diamond members only.

      25.   How can I identify or recognise the Participating Outlets that offer privileges to T Privilege Loyalty Programme?
      All our participating merchants or outlets with their special discounts and deals offered to T Privilege members will display a glass sticker of the T Privilege Loyalty Programme logo. Alternatively, members can log on to https://www.tropicanacorp.com.my/t-privilege-loyalty-programme or the Tropicana 360 App for the updated listing of the participating merchants.

      26.   How do I collect points for my property purchase?
      Points will be awarded to property purchases made from 1 January 2022 onwards. The points will be reflected in the Tropicana 360 App to Members who had successfully purchased a property from participating Tropicana Projects by executing the SPA and having paid a sum not less than Thirty-five (35%) percent of the total purchase price of the Tropicana Property.
